TEILNAHME- UND WETTBEWERBSBEDINGUNGEN

Mit der Teilnahme an dem Gewinnspiel der DAZN DACH GmbH, Münchener Straße 101, 85737 Ismaning, (nachfolgend "DAZN" genannt) erklärt sich der/die Teilnehmer/in mit diesen nachstehenden Teilnahmebedingungen und der Inhaltsverantwortung einverstanden.

Um am Gewinnspiel teilzunehmen, musst du nur unter dem DAZN-Gewinnspiel-Post auf unserem Instagram-Kanal @dazn_de einen Spieler kommentieren, der den Ball unterschrieben haben könnte, liken und dem Kanal folgen.

Unter allen Teilnehmern werden per Zufall die Gewinner ausgewählt.

Das Gewinnspiel startet am 23.04.2025 mit Veröffentlichung des Posts auf Instagram und endet am 28.04.2025, 23:59 Uhr.

4. WER KANN MITMACHEN?

Die Teilnahme am Gewinnspiel ist kostenlos und jeder natürlichen Person mit Wohnsitz in Deutschland erlaubt. Bei minderjährigen Teilnehmer/innen setzt DAZN das Einverständnis der Erziehungsberechtigten voraus. Gewinnspielvereine sowie automatisierte Gewinnspiel-Dienste sind nicht teilnahmeberechtigt. Auch die Teilnahme über falsche Instagram-Konten (Fake-Accounts) ist unzulässig.

5. WER WIRD VON DER TEILNAHME AUSGESCHLOSSEN?

DAZN ist berechtigt, einzelne Personen von der Teilnahme am Gewinnspiel bzw. der Verlosung auszuschließen, sofern berechtigte Gründe, wie z. B. Verstoß gegen diese Teilnahmebedingungen, doppelte oder mehrfache Teilnahme, Manipulation etc., vorliegen und behält sich vor, gegen diese Personen rechtliche Schritte einzuleiten.

6. WIE ERFAHRE ICH, OB ICH GEWONNEN HABE?

Der/Die Gewinner/in wird über einen Kommentar oder eine Nachricht direkt von DAZN angeschrieben. Diese Benachrichtigung erfolgt binnen einer Woche nach Ermittlung des/der Gewinners/in.

7. WIE ERHALTE ICH MEINEN GEWINN?

Mit der Gewinnbenachrichtigung wird der/die Gewinner/in aufgefordert, DAZN die zur Übersendung oder Übergabe des Gewinns erforderlichen Kontaktdaten (Name, Adresse in Deutschland) per Instagram Privatnachricht an den DAZN-Channel zu senden. Für die Richtigkeit der angegebenen Kontaktdaten ist der/die Gewinner/in verantwortlich.

8. WAS PASSIERT, WENN ICH MICH NACH GEWINNBENACHRICHTIGUNG NICHT MELDE?

Sollte sich der/die Gewinner/in nicht innerhalb von 3 Tagen nach Gewinnbenachrichtigung bei DAZN melden, verfällt der Gewinn. Dasselbe gilt für den Fall, dass ein/e Gewinner/in DAZN falsche Kontaktdaten mitteilt und die Übersendung oder Übergabe des Gewinns deshalb nicht möglich ist.

9. VORBEHALTSKLAUSEL

DAZN behält sich vor, das Gewinnspiel zu jedem Zeitpunkt ohne Vorankündigung und ohne Angabe von Gründen abzubrechen oder zu beenden. Von dieser Möglichkeit macht DAZN allerdings nur dann Gebrauch, wenn aus technischen Gründen (z. B. Viren im Computersystem, Manipulation oder Fehler in der Hard- und/oder Software) oder aus rechtlichen Gründen eine ordnungsgemäße Durchführung des Gewinnspiels nicht gewährleistet werden kann.

10. ABSTANDSERKLÄRUNG

Dieses Gewinnspiel steht in keiner Verbindung zu Facebook und/oder Instagram und wird in keiner Weise von Facebook und/oder Instagram gesponsert, unterstützt oder organisiert. Empfänger der vom Teilnehmer bereitgestellten Informationen ist nicht Facebook oder Instagram, sondern DAZN. 11. DATENSCHUTZBESTIMMUNGEN

Mit der Teilnahme am Gewinnspiel erklärt sich der/die Teilnehmer/in ausdrücklich damit einverstanden, dass DAZN die dazu erforderlichen Daten, insbesondere die im Rahmen der Teilnahme und zur Übergabe eines möglichen Gewinns gemachten persönlichen Angaben, für die Dauer des Gewinnspiels und zum Zwecke der Abwicklung des Gewinnspiels speichert und verwendet. Es steht dem/der Teilnehmer/in jederzeit frei, per Widerruf via E-Mail an dl-dach.social@dazn.com die Einwilligung in die Speicherung und Verwendung der betroffenen Daten zu widerrufen und somit von der Teilnahme an diesem Gewinnspiel zurückzutreten. DAZN gewährt im Rahmen dieses Gewinnspiels den größtmöglichen datenschutzrechtlichen Standard und beachtet alle diesbezüglich einschlägigen gesetzlichen Bestimmungen. Personenbezogene Daten werden nicht an Dritte weitergegeben oder verkauft.

12. RECHTEEINRÄUMUNG

Mit der Teilnahme am Gewinnspiel erklärt sich der/die Teilnehmer/in damit einverstanden, dass DAZN die Kommentare unter dem Gewinnspiel-Posting inklusive Nutzernamen uneingeschränkt nutzen und veröffentlichen darf. In diesem Zusammenhang überträgt der/die Teilnehmer/in DAZN sämtliche ihm/ihr an den Aufnahmen zustehenden und übertragbaren Rechte zur ausschließlichen sowie zeitlich, räumlich und inhaltlich unbeschränkten Nutzung. 13. SONSTIGES

Die Barauszahlung des Gewinns ist nicht möglich. Gewinnansprüche können nicht auf andere Personen übertragen oder abgetreten werden. Der Rechtsweg ist, soweit gesetzlich zulässig, ausgeschlossen.

Diese Teilnahmebedingungen unterliegen deutschem Recht unter Ausschluss des UN-Kaufrechts.

Sollten einzelne Bestimmungen dieser Teilnahmebedingungen ungültig sein oder ungültig werden, bleibt die Gültigkeit der übrigen Teilnahmebedingungen unberührt. An die Stelle der unwirksamen Regelung tritt eine angemessene Regelung, die dem Zweck der unwirksamen Bestimmung am ehesten entspricht. CONDITIONS OF PARTICIPATION AND COMPETITION

By participating in the competition organized by DAZN DACH GmbH, Münchener Straße 101, 85737 Ismaning, Germany (hereinafter referred to as "DAZN"), the participant agrees to the following conditions of participation and responsibility for the content.

 

1. WHAT CAN YOU WIN?

1 x 1 signed Wilson NBA ball

2. HOW CAN YOU ENTER?

To take part in the competition, all you have to do is comment under the DAZN competition post on our Instagram channel @dazn_de on a player who might have signed the ball, like it and follow the channel.

The winners will be selected at random from all participants.

The competition starts on 23.04.2025 with the publication of the post on Instagram and ends on 28.04.2025, 23:59.

4. WHO CAN TAKE PART?

Participation in the competition is free of charge and open to any natural person resident in Germany. For underage participants, DAZN requires the consent of a parent or legal guardian. Sweepstakes clubs and automated sweepstakes services are not eligible to participate. Participation via false Instagram accounts (fake accounts) is also not permitted.

5. WHO IS EXCLUDED FROM PARTICIPATION?

DAZN is entitled to exclude individual persons from participation in the competition or the prize draw if there are justified reasons, such as violation of these conditions of participation, double or multiple participation, manipulation, etc., and reserves the right to take legal action against these persons.

6. HOW DO I FIND OUT IF I HAVE WON?

The winner will be contacted directly by DAZN via a comment or message. This notification will be sent within one week of the winner being determined.

7. HOW DO I RECEIVE MY PRIZE?

With the prize notification, the winner will be asked to send DAZN the contact details required to send or hand over the prize (name, address in Germany) via Instagram private message to the DAZN channel. The winner is responsible for the accuracy of the contact details provided.

8. WHAT HAPPENS IF I DO NOT CONTACT YOU AFTER I HAVE BEEN NOTIFIED OF MY WIN?

If the winner does not contact DAZN within 3 days of being notified of the prize, the prize will be forfeited. The same applies in the event that a winner provides DAZN with incorrect contact details and it is therefore not possible to send or hand over the prize.

9. RESERVATION CLAUSE

DAZN reserves the right to cancel or terminate the competition at any time without prior notice and without giving reasons. However, DAZN will only make use of this option if for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons the proper execution of the competition cannot be guaranteed.

This competition is in no way connected to Facebook and/or Instagram and is in no way sponsored, supported or organized by Facebook and/or Instagram. The recipient of the information provided by the participant is not Facebook or Instagram, but DAZN. 11. DATA PROTECTION PROVISIONS

By participating in the competition, the participant expressly agrees that DAZN may store and use the necessary data, in particular the personal data provided in the context of participation and for the transfer of a possible prize, for the duration of the competition and for the purpose of processing the competition. The participant is free to revoke his/her consent to the storage and use of the data concerned at any time by sending an e-mail to dl-dach.social@dazn.com and thus withdraw from participation in this competition. DAZN guarantees the highest possible standard of data protection in the context of this competition and observes all relevant legal provisions in this regard. Personal data will not be passed on or sold to third parties.

12. GRANTING OF RIGHTS

By participating in the competition, the participant agrees that DAZN may use and publish the comments under the competition posting, including user names, without restriction. In this context, the participant transfers to DAZN all transferable rights to which he/she is entitled to the recordings for exclusive use without restriction in terms of time, space and content. In particular, DAZN is entitled to distribute the recordings on all digital channels of DAZN and on partner sites of DAZN.

13. MISCELLANEOUS

Cash payment of the prize is not possible. Prize claims cannot be transferred or assigned to other persons. Legal recourse is excluded to the extent permitted by law.

These conditions of participation are subject to German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

Should individual provisions of these conditions of participation be or become invalid, this shall not affect the validity of the remaining conditions of participation. The invalid provision shall be replaced by an appropriate provision that comes closest to the purpose of the invalid provision. DAZN reserves the right to amend these Terms and Conditions of Participation at any time.
